What is Trademark Registration?

A trademark protects your brand name, logo, tagline or packaging from being copied. In India, trademarks are governed by the Trade Marks Act, 1999 and filed with the Controller General of Patents, Designs and Trade Marks. Once your TM application is filed you can use the ™ symbol immediately, and ® once registration is granted (typically 12–24 months).

  • Logo / word mark in JPG (for logo TMs)
  • PAN of applicant (individual, LLP, company, partnership)
  • Address proof of applicant
  • MSME / Udyam certificate (for discounted government fee)

How the process works

Step-by-step from consultation to certificate.

  1. 1

    Free brand search

Our IP attorney searches the Indian Trade Marks Registry for identical or deceptively similar marks in your class.

  2. 2

    Class selection

We identify the correct Nice Classification class (1–45) based on your goods or services.

  3. 3

    TM-48 execution

You sign a power of attorney authorizing our attorney to file on your behalf.

  4. 4

    TM-A filing

We file Form TM-A online with the Trade Marks Registry. You receive an application number within 3 days and can start using ™.

  5. 5

    Examination

The examiner issues an examination report in 3–6 months. We draft and file the response within 30 days.

  6. 6

    Journal publication

If accepted, your mark is published in the Trade Marks Journal for 4 months for third-party opposition.

  7. 7

    Registration certificate

If no opposition or opposition is defeated, the registration certificate is issued and you can start using ®.

Frequently asked questions

Answers about trademark registration.

How long does trademark registration take in India?

The application number is generated within 3 days. Full registration typically takes 12–24 months depending on examination and any opposition.

What are the 45 trademark classes?

The Nice Classification divides goods (classes 1–34) and services (classes 35–45). For example, software falls under class 9, restaurant services under class 43, and legal services under class 45.

What is the government fee for trademark registration?

₹4,500 per class for individuals, startups, and MSMEs; ₹9,000 per class for all other applicants. Our Basic package price includes the discounted individual/MSME fee.

Can I trademark a logo and word mark separately?

Yes. A word mark protects the text and any font; a logo mark protects the specific design. Filing both gives strongest protection.

What if my trademark is objected to?

The examiner will cite grounds (usually similarity to existing marks or descriptiveness). Our Standard and Premium packages include drafting a response within the 30-day window.

Do I need to renew my trademark?

Yes, every 10 years. We send renewal reminders in the Premium package.
